NPOV LIONS RAILRIDERS TERMS & CONDITIONS: WAIVER & SAFETY INSTRUCTIONS

In exchange for participation in NPOV Lions Railriders, organized by NPOV Lions Club, of 101 Railroad Ave, Ione WA 99139 and/or use of the property, equipment, facilities and services of NPOV Lions Club, I agree for myself and for the member(s) of my family or group to which I purchase these tickets on behalf of, to the following:
 

1. AGREEMENT TO FOLLOW INSTRUCTIONS. I agree to observe and obey all posted rules and warning, and further agree to follow any oral instructions or directions given by NPOV Lions Railriders/NPOV Lions Club or ANY of the employees, representatives or agents of NPOV Lions Railriders/NPOV Lions Club at ALL times. This includes any and all times during the ride, the turnstiles stations, and return ride to the departure area.

At NPOV Lions Railriders safety is our first priority. Tours depart on a set schedule, but riders will begin to spread out, with up to 30 feet between you and those in front and behind. The distance between the bikes allows everyone to go at their own pace and enjoy the magic of riding the rails in solitude. Keep a safe distance between yourself and the Railrider in front. When braking, slowing, or stopping, raise your hand to alert those behind you.

Do not tailgate! Do not intentionally bump other Railriders.

Each railrider has 4 seats. Each scheduled ride can have up to 11 railriders. With your reserved 4 seat railrider, you will not be sharing a railrider with someone not in your party. Railriders cannot accommodate carry-on items such as backpacks, ice chests or other bulky items.

This includes any type of animals/petsDuring tours guests must conduct themselves in a way that is respectful of the privacy and security of adjacent homeowners.

• ​To use your car seat (ticket purchase required), be sure to arrive 40 minutes early to allow time to secure the car seat. A ticket is not required for a child/infant (1 year old and under) held in a front infant pack of a responsible adult.

• Children under the age of 16 are not permitted to operate the brakes and must be accompanied by an
  older rider.
   

• Bodyweight does not exceed 250 pounds as required by wheel manufacturer
   

• No smoking or vaping (E-cigarettes) at any time on the tours and/or NPOV Lions Club property.
   

• Always keep your safety belt fastened.
   

• Do not get out of the Railrider during the tour except during the Turnstiles turnaround
   

• Please make sure all your belongings are secured.
   

• Parents / guardians are responsible for their minors and must ensure that they follow the
  instructions of NPOV Lions Railriders/NPOV Lions Club Volunteers or ANY of the employees,
  representatives or agents of NPOV Lions Railriders/NPOV Lions Club at ALL times.
   

• Stop at all road crossing and cross only with the direction of NPOV Lion’s Railriders staff.
  You will cross a State Hwy as a group. Only proceed when advised by NPOV Lions Railrider volunteer staff
  member. Slow down when passing through rail switches and over country roads.
   

• There are No restrooms along the route or Box Canyon turn around location (restrooms only at the Lions
  Depot).
   

• Know your limits, health and physical condition. There is approximately a 1-1 1/2% grade variation
  pedaling to Box Canyon Dam that requires effort to reach Box Canyon Dam. Rail Riding is a
  PHYSICAL SPORT and guests are EXPECTED to pedal unless you have prior arrangements with your
  group members. Riders should be capable of bicycling recumbently for 30-60 minutes. The ride is
  enjoyable but can be strenuous. This is approximately a two-hour self-pedaled round trip excursion.
   

• I am in good health and in proper physical condition to participate in the Activity; and I
  am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair
  my ability to safely participate in the Activity.
   

• I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough
  to participate in the Activity.
   

• I acknowledge that rail riding is a physical outdoor sport and subject to changeable outdoor
  conditions.
   

• Box Canyon Dam: 3 miles north (6 miles round trip). When arriving, pedal up to the turn around
  area and disembark only when NPOV Lions Railrider volunteer staff instruct you to disembark. At
  all times walk only on the canyon wall side of tracks as instructed. You will walk a short distance to
  view the dam and trestle. Do Not cross or stand on the barrier at Box Canyon Dam.
  Do Not change seat location on your Railrider due to specific weight distributions needed.
  Do Not re-board until a NPOV Lions Railrider volunteer staff members direct you.
  
  Ride times: Lions Depot to Box Canyon Dam—6 miles round trip—1 ½-2 hr.

 
2. ASSUMPTION OF THE RISKS AND RELEASE: I recognize that there are certain inherent risks associated
with the above-described activity and I assume full responsibility for personal injury to myself and my

family members/group members, and further release and discharge NPOV Lions Railriders/NPOV Lions
Club or injury, loss or damage arising of my or my family’s or group members use of or presence upon
the facilities of NPOV Lions Railriders/NPOV Lions Club, whether caused by the fault of myself, my
family or group, NPOV Lions Railriders/NPOV Lions Club or other third parties.
 
3. INDEMNIFICATION. I agree to indemnify and defend and Hold Harmless NPOV Lions Railriders/NPOV
Lions Club against all claims, causes of action, damages, judgments, costs of expenses, including
attorney fees and any & all litigation costs, which may in any way arrive from me or my family’s or
groups use of or presence upon the facilities of NPOV Lions Railriders/NPOV Lions Club.
 
4. FEES. I agree to pay for damages to the facilities of NPOV Lions Railriders/NPOV Lions Club caused by
any negligent, reckless, or willful actions by me or my family.
 
5. CONSENT. I consent to the participation of my family/group and myself in the activity of railriding, ]
and agree on behalf of the above to all the terms and conditions of this agreement. By signing this
release of liability, I represent that I have legal authority over and custody of minors of my family/
group.
 
6. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be
resolved under Washington law.
 
7. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this agreement
and that I have been given a reasonable opportunity to review it before signing.
 
8. ENFORCEABLITY. The invalidity or unenforceability of any provision of this agreement, whether
standing along or as applied to a particular occurrence or circumstance, shall not affect the validity or
enforceability of any other provisions of this agreement or any other applications of such provisions,
as the case may be, and such invalid or unenforceable provisioned shall be deemed not to be a part
of this agreement.
 
9. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising of or relating to this
agreement through friendly negotiations amongst the parties. If the matter is not resolved by
negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution
procedure. Any controversies or disputes arising out of or relating to this agreement will be resolved by
binding arbitration under the rules of the American Arbitration Association. The arbitrator’s award will
be final, and any judgment may be entered upon it by any court having proper jurisdiction
 

• I hereby represent that I and/or my family is in good health and in proper physical condition to

participate in the Activity. I agree that it is my sole responsibility to determine whether I am sufficiently
fit and healthy enough to participate in the Activity. I am not under the influence of alcohol, marijuana,
or any elicit or prescription drugs, which would in any way, impair my ability to safely participate in the
Activity.
 

• NPOV Lions Railriders/NPOV Lions Club reserves the right to cancel or amend any trip or booking for any

reason and assumes no responsibility for any personal injury, loss or damage to personal equipment,
delays or irregularities which may occur in the course of the NPOV Lion’s Railriders season.
 

• I am voluntarily participating in the activity, and I am participating in the activity entirely at my own risk.
   

• I will allow pictures and videos to be used for promotional purposes.​
